In New York City a service may not be called non-cancellable, and a sum kept when plans change must be in proportion to the loss. So this practice says what a late cancellation costs, keeps it to the hour that was held, and waives the first one.

Why a practice says it, and why it misleads

A practice sells hours, and an hour that is not used cannot be given to anybody else, so a hard line about late cancellation looks like a fair way to protect it.

It misleads when the line leaves no room for a bad week. Wording that leaves no room for exceptions tells a reader that an illness or a family emergency will cost them money and that nobody will listen. That can keep people from booking, and from telling the practice when they are ill. The same business need can be said without a threat: the rule stated in advance, tied to the hour that was held, with the first occasion forgiven and nothing charged when the practice is the one that cancels.

Stating the rule before booking, in every case, is also a courtesy. Nobody learns it from a bill.

What the law says

As it read in October 2026.

A contract for consumer services may not be described as non-cancellable unless the seller has already done everything it promised (6 RCNY § 5-34).

A sum kept when an agreement is broken is enforced only if it bears a reasonable proportion to the probable loss (Truck Rent-A-Center v. Puritan Farms 2nd, 41 N.Y.2d 420 (1977)).

What this practice does

  • Cancel or move a session at least twenty-four hours ahead, from the link in your confirmation or by calling, and there is nothing to pay.
  • Cancel with less than twenty-four hours' notice, or miss a session, and the session's fee is charged, because the hour was kept for you and nobody else could have it.
  • The first late cancellation or missed session in any twelve months is waived, with no reason needed.
  • If the practice has to cancel, you never pay anything for that session.
  • A late fee is never sent to your insurance, and a free call is never charged, however it is missed.
