A practice of five clinicians cannot answer the telephone at three in the morning, and a website that says it can is promising care nobody will give. So this practice says plainly that it is not an emergency service, and puts 988 and 911 on every page.

Why a practice says it, and why it misleads

Somebody reading a therapy site late at night wants to know that a person will answer. A line that says someone is always on hand answers that worry in one sentence, and some sites lean on it.

It misleads because the reader it works on hardest is the one who can least afford to be wrong. A small practice has appointment hours, a voicemail and an inbox that people read on working days. A reader who reaches out in a crisis and waits for an answer that is not coming has been let down by the website before anything else has happened.

The honest sentence is the less comforting one, and it does more good: it sends the reader to the people who do answer, and it puts them in front of the reader before the need arises, on every page.

A licensed professional may not advertise in a way that is false or misleading, or make a claim it cannot substantiate (8 NYCRR § 29.1(b)(12)).

False advertising in the conduct of any business is unlawful in New York (GBL § 350).

What this practice does

If you're in danger right now, call 911. For a mental health crisis, call or text 988 or chat at 988lifeline.org, 24 hours a day; veterans can call 988 and press 1. You can also text HOME to 741741. Our phone and messages are not monitored outside office hours, and this website is not an emergency service.

Messages are answered Monday to Friday, 9 am to 5 pm, and returned within one working day. They are not watched in the evening, at night or at weekends.

Between sessions your clinician agrees with you what to do if things get worse, and that plan includes 988.
